Findb is in pre-launch. These terms will be updated before the app opens to the public.
These Terms of Use set out the rules for using Findb. Please read them carefully. By creating an account, joining or hosting a plan, or otherwise using the Findb app or website, you agree to these terms, our Privacy Policy and our Community Guidelines. If you don't agree, please don't use Findb.
Who we are and what Findb is
Findb (pronounced "Find B") is operated by Findb ("we", "us", "our"), based in Sydney, New South Wales, Australia. You can reach us at hello@findb.co.
Findb is an app (for iOS and Android) and a website at findb.co. Members host "plans" (activities, sport, outdoors, food, nights out, trips, car meets and more) and other verified members ask to join. We provide the platform, plus tools like group chat, payments, check-in and reviews.
Eligibility and your account
You must be at least 18 years old to create an account or use Findb. By using Findb, you confirm that you are 18 or over and legally able to agree to these terms.
Browsing and joining
Anyone can browse plans. To join or host a plan, send messages or leave reviews, you need a verified profile (see Verification).
Keeping your account accurate and secure
- Use your real name (or the name you're commonly known by) and a recent, clear photo of yourself as your profile photo.
- Keep your details, including your email and mobile number, up to date.
- Keep your login secure and don't share your account. You're responsible for activity on your account.
- One person, one account. Don't create accounts for others or create a new account after we've suspended or removed you.
Verification (selfie check)
To help members trust that people are who they say they are, every member who joins or hosts plans must complete a selfie check. You'll add a profile photo, then take a live selfie in the app. A third-party identity verification provider compares the live selfie with your profile photo to confirm they match. We don't ask you to scan photo ID.
The selfie check involves biometric information, which is sensitive information under the Privacy Act 1988 (Cth). We'll ask for your express consent before you start, and we handle that information as described in our Privacy Policy. If you don't consent, you can still browse, but you won't be able to join or host plans.
Verification lowers risk, but it doesn't eliminate it. A verified badge means a person's live selfie matched their profile photo at the time of the check. It isn't a background check, criminal record check or guarantee of anyone's identity, character or behaviour. We may ask you to verify again at any time, for example if you change your profile photo or if we have concerns about an account.
Plans, hosts and members
Findb is a platform, not the organiser
Plans are created and run by hosts, not by Findb. We don't organise, supervise, control or attend plans, and we aren't a party to any arrangement between hosts and members. Hosts are independent and are not our employees, agents or contractors. We don't check every listing before it goes live, and we don't guarantee that any plan will go ahead or be as described.
Host responsibilities
If you host a plan, you're responsible for it. You agree to:
- Describe the plan accurately, including what's involved, the location, time, skill or fitness level needed, and anything a reasonable person would want to know before joining.
- Show all costs clearly before anyone pays, and set out your cancellation and refund terms in the listing.
- Take reasonable care for the safety of the people who join, including giving a safety briefing where the activity calls for one, and keeping the plan within the abilities of those attending.
- Get any permits, licences, bookings, insurance or approvals your plan needs, and follow any rules that apply to the venue or location.
- Make sure your plan is legal, including under laws on alcohol, driving, food handling and public gatherings.
- Turn up as promised, or cancel as early as possible through the app.
If you charge for your plan, you may be providing goods or services to consumers, and you're responsible for meeting your own obligations under the Australian Consumer Law and any tax laws (including GST, if you're registered or required to be).
Member responsibilities
If you join a plan, you agree to:
- Read the plan details, costs and cancellation terms before you request a spot or pay.
- Only join plans you are able and fit to take part in, and tell the host about anything relevant, such as a medical condition that affects your ability to do the activity safely.
- Follow the host's reasonable instructions and safety briefings, and the rules of the venue or location.
- Show up on time, or cancel through the app as early as you can.
Risk and personal responsibility
Many plans involve physical activity, the outdoors, water, vehicles or alcohol, which carry a real risk of injury, illness or property damage. You decide which plans to host or join, and you take part by choice.
Before you join, think about whether a plan suits your health, fitness, skills and experience. You can leave any plan at any time.
If alcohol is involved, drink responsibly, never drive or ride after drinking, and look out for others. Hosts must not supply alcohol to anyone who is visibly intoxicated, and must follow any licensing laws that apply.
Findb does not provide insurance for plans, hosts or members. You may wish to arrange your own cover.
Nothing in this section limits any rights you have under the Australian Consumer Law or other laws that can't be excluded.
Payments, fees and refunds
Free, split-cost and paid plans
Hosts can keep a plan free, ask members to split shared costs, or charge per spot. Whatever the host chooses, the total amount you'll pay is shown in the app before you confirm.
Stripe
Payments on Findb are processed by Stripe through Stripe Connect. Hosts who accept payments must set up a Stripe account and agree to Stripe's terms, including the Stripe Connected Account Agreement. We don't store full card numbers. Stripe may need to verify a host's identity and bank details before paying them out.
Our fees
On paid plans, we charge hosts a service fee and charge guests a booking fee. The fees that apply are shown in the app before anyone pays. Founding hosts may have their fees waived for an introductory period, as advertised at the time. We may change our fees in the future, but any change won't apply to a booking that's already been paid for. Findb Plus subscribers don't pay booking fees (see Findb Plus subscriptions).
Cancellations and refunds
- If a host cancels a paid plan, or the plan doesn't go ahead, members who paid will receive a full refund of the amount they paid, including the booking fee.
- If you cancel as a member, the host's cancellation and refund terms shown in the listing apply. Booking fees may be non-refundable where the listing or app says so, subject to your rights under the law.
- If a plan is significantly different from its description, or a host doesn't show up, tell us through the app as soon as you can and we'll look into it.
Disputes
If something goes wrong with a paid plan, we encourage hosts and members to try to resolve it directly and respectfully through the app first. If you can't, contact us and we'll help. We may review messages and check-in records and decide to issue a full or partial refund. Hosts agree that we may recover refunded amounts from their future payouts where a refund is owed because of the host's conduct.
Never pay or accept payment for a plan outside the app. Payments made outside Findb aren't protected by our refund process, and asking for off-app payment breaks these terms.
Findb PRO
Findb PRO is for verified hosts who host regularly. PROs receive a PRO badge and their own page, and can sell packs (for example, a set number of plans bought together).
- You can apply to become a PRO through the app or our website. We review each application and decide, at our discretion, whether to grant the badge.
- A PRO badge shows that we've reviewed the host's application. It isn't an endorsement, qualification, licence or guarantee of the quality or safety of their plans.
- PROs must meet all host responsibilities in these terms, plus any further PRO requirements we publish. PROs offering coaching or instruction must hold any qualifications those services require.
- PROs may choose to hold their own public liability insurance. Findb does not provide insurance for PROs or their plans.
- Packs must clearly state what's included, how long they're valid for, and the refund terms. Unused plans in a pack must be handled fairly and in line with the Australian Consumer Law.
Findb Plus subscriptions
Findb Plus is an optional monthly subscription. Plus currently includes no booking fees, unlimited join requests, priority with hosts, the ability to see who's going to a plan, and smart filters.
- Plus is billed through the Apple App Store or Google Play, and the store's terms apply to that billing.
- Your subscription renews automatically each month at the price shown at sign-up unless you cancel at least 24 hours before the renewal date.
- You can cancel anytime in your App Store or Google Play subscription settings. Deleting the app or your Findb account doesn't cancel your subscription on its own.
- When you cancel, you keep Plus until the end of the billing period you've already paid for.
- Refund requests for Plus are handled by Apple or Google under their policies. This doesn't affect your rights under the Australian Consumer Law.
"Priority with hosts" means your join requests may be shown more prominently. Hosts still decide who joins their plans.
Partner venues
We may suggest partner venues to hosts (businesses such as restaurants, bars, gyms or activity providers), sometimes with a perk for groups. Partner venues are independent businesses. They're responsible for their own goods, services, premises and perks, and the venue's own terms apply. Perks are offered by the venue, may have conditions and may change or end. We may receive a commercial benefit from partner venues, and we'll make it clear when a suggestion is a partner venue.
Conduct and community guidelines
Findb works because members treat each other well. You must follow our Community Guidelines, which form part of these terms. In particular, you must not:
- Impersonate anyone or misrepresent yourself.
- Harass, threaten, stalk, abuse or discriminate against anyone.
- Make unwanted sexual advances or share sexual content.
- Use Findb for commercial spam, recruitment schemes or unsolicited advertising.
- Host, promote or take part in illegal or dangerous activity.
- Ask for or arrange payment outside the app, or run scams.
- Collect other members' personal information, or use it for anything other than the plan you're part of.
- Scrape, reverse engineer or interfere with Findb, or access it by automated means without permission.
Content you share and licence to us
You own the content you share on Findb. You're responsible for it, and you confirm that you have the right to share it and that it doesn't break the law or anyone else's rights.
So we can run Findb, you give us a non-exclusive, worldwide, royalty-free, transferable and sub-licensable licence to host, store, copy, display, adapt (for example, resize or crop) and distribute your content in connection with operating, improving and promoting Findb. This licence ends when you delete the content or your account, except where your content has been shared with others (for example, messages in a group chat or reviews), where we need to keep it for legal reasons, or for reasonable backup periods.
We won't use your profile photo or name in advertising outside the app without asking you first.
We may remove or restrict any content that we reasonably believe breaks these terms or our guidelines, or that could harm members or Findb.
Reviews and ratings
After a plan, hosts and members can rate and review each other. Reviews help everyone make good choices, so they must be honest and based on your own genuine experience of that plan.
- Don't post fake reviews, review yourself, or offer or accept anything in exchange for a review.
- Don't use reviews to threaten, pressure or retaliate against someone.
- Don't include personal information, discriminatory comments or abuse.
We don't edit reviews to change their meaning, but we may remove reviews that break these rules or the law. Ratings and reviews contribute to host levels, which reflect things like hosting activity, reliability and feedback. Host levels are a guide only and aren't a guarantee of any host's conduct.
Safety, reporting and enforcement
You can report a member, plan, message or review through the app, or by emailing hello@findb.co. You can also block another member at any time. If anyone is in immediate danger, call 000 first.
Safety features include check-in on the day and an optional notification to a trusted contact when you check in. We don't track the live location of other people.
We review reports and take action we consider appropriate. Depending on what happened, we may:
- Give a warning, or remove content, plans or reviews.
- Limit features, or remove a badge or host level.
- Hold payouts and refund members.
- Suspend or permanently remove your account.
- Share information with police or other authorities where the law allows or requires, or where we believe it's needed to protect someone's safety.
We'll usually tell you if we act on your account and why, unless that could put someone at risk. If you think we've got it wrong, contact us and we'll review it.
Intellectual property
The Findb name, logo, app, website, design, software and all content we create (other than members' content) belong to us or our licensors and are protected by intellectual property laws. We give you a limited, personal, non-exclusive, non-transferable and revocable licence to use the app and website for their intended purpose under these terms. You must not copy, modify, distribute or use our brand or materials without our written permission.
If you believe content on Findb infringes your rights, email hello@findb.co.
Our liability
Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited ("Non-Excludable Rights").
Limits on our liability
Subject to your Non-Excludable Rights:
- Findb is provided "as is". We don't promise it will always be available or error-free.
- Because hosts, members and partner venues are independent, we aren't responsible for their acts or omissions, for the conduct of anyone you meet through Findb, or for what happens at a plan.
- We aren't liable for any indirect or consequential loss, or for loss of profits, revenue, data or opportunity.
- Where our liability for a failure to comply with a consumer guarantee can be limited, our liability is limited (at our option) to supplying the services again or paying the cost of having them supplied again.
- Otherwise, our total liability to you in connection with Findb is limited to the greater of the fees you paid to us in the 12 months before the claim arose, or AUD $100.
These limits don't apply to the extent that loss is caused by our fraud, negligence or wilful misconduct, or to the extent the law doesn't allow them.
Your responsibility to us
To the extent permitted by law, you agree to cover our reasonable losses and costs arising from your breach of these terms, your content or your plans, except to the extent we caused them.
Changes to these terms
We may update these terms from time to time, including before the app opens to the public. If we make significant changes, we'll let you know in the app, by email, or on our website before they take effect. The "Last updated" date at the top shows when these terms last changed. If you keep using Findb after that, you accept the updated terms.
Ending your account
You can close your account at any time in the app settings or by emailing hello@findb.co. Before you go:
- Cancel any plans you're hosting, and any upcoming plans you've joined, so others aren't left waiting. Refunds for hosted plans will be handled as set out above.
- Cancel any Findb Plus subscription through the App Store or Google Play.
We may suspend or close your account if you breach these terms, if we're required to by law, if your account has been inactive for a long period, or if we stop offering Findb. Where it's reasonable to do so, we'll give you notice. Sections that by their nature should survive (such as payments owed, liability and governing law) continue to apply.
Governing law and disputes
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts that can hear appeals from them.
If you have a problem with Findb, please contact us first. We'll try to resolve it quickly and fairly, and both of us agree to try in good faith to settle any dispute informally before starting court proceedings (except where urgent relief is needed). This doesn't stop you from contacting a consumer protection agency such as NSW Fair Trading or the ACCC.
If any part of these terms is unenforceable, the rest still applies. We may transfer our rights under these terms as part of a restructure or sale, provided your rights aren't reduced.
